HVAC POCKET PRO — END USER LICENSE AGREEMENT
Product: Ductless Master and related HVAC Pocket Pro services (the “Service”)
Effective date: September 14, 2026
Last updated: October 3, 2026
EULA version: 2026-09-14
Provider: HVAC Pocket Pro LLC, an Illinois limited liability company (“HVAC Pocket Pro,” “we,” “us,” or “our”)
Public URL: https://www.hvacpocketpro.com/blank-8
IMPORTANT SAFETY NOTICE
The Service is a professional reference and productivity tool. It is not a substitute for training, a license, certification, a manufacturer’s current instructions, a code official, or an on-site safety assessment. HVAC work can cause electric shock, arc flash, fire, explosion, refrigerant injury, toxic exposure, moving-part injury, property damage, serious injury, or death. Read the safety and field-verification provisions below before using the Service.
1. ACCEPTANCE OF THIS AGREEMENT
This End User License Agreement (“Agreement”) is a binding agreement between you and HVAC Pocket Pro. It governs your download, installation, access to, and use of the Service, including the Ductless Master mobile application, websites, content, account features, and related services. By selecting an acceptance control, creating an account, downloading the application, or accessing or using the Service, you acknowledge that you have read and understood this Agreement and agree to be bound by it. If you do not agree, do not access or use the Service.
The Service’s Privacy Policy, available at https://www.hvacpocketpro.com/blank-1, is incorporated into this Agreement by reference. If a paid order, promotion, or other written term expressly conflicts with this Agreement, that specific term controls only to the extent of the conflict.
1.1 Acceptance records
When an authenticated user accepts this Agreement, HVAC Pocket Pro records the acceptance using the authenticated Firebase user ID (UID) verified by our server. The acceptance record is keyed by the combination of that UID and EULA version 2026-09-14, so a repeat submission for the same UID and version is idempotent and does not create a different acceptance. The record contains only the following acceptance fields, as applicable: UID, verified name and email fetched from the server, server-generated acceptance timestamp, EULA version, EULA effective date (2026-09-14), app version, and platform.
We do not rely on a client-supplied identity or timestamp. The server obtains the verified name and email from Firebase Authentication when available, and generates the acceptance time. Acceptance records are immutable: there is no user or application path to update or delete an acceptance record. We retain these records for the lifetime of the account and for seven (7) years thereafter, subject to lawful preservation obligations and applicable law. This recordkeeping does not change any deletion rights described in the Privacy Policy where those rights apply.
2. ELIGIBILITY AND PROFESSIONAL USE
You must be at least eighteen (18) years old to use the Service. By using it, you represent that you meet that minimum age and have the legal capacity to enter this Agreement. The Service is designed exclusively for licensed, certified, trained, or otherwise legally authorized HVAC professionals acting within the scope of their training and authorization. It is not intended for homeowners, do-it-yourself users, children, or untrained persons.
You are responsible for complying with all laws, licensing requirements, permits, occupational-safety requirements, manufacturer requirements, and local, state, national, and other applicable building, electrical, fire, environmental, and refrigerant codes. If you are not qualified and authorized to perform the work involved, stop and contact a qualified professional.
3. INFORMATIONAL GUIDANCE; MANDATORY FIELD VERIFICATION
The Service may provide technical data, fault codes, wiring diagrams, installation and service documents, charging information, compatibility information, diagnostic suggestions, calculators, videos, and images. Some material is compiled from manufacturer technical literature and other sources. It may be incomplete, outdated, unavailable, incorrectly transcribed, model-specific, region-specific, or inconsistent with a revision, bulletin, code, or actual equipment.
Before relying on any information or taking any action, you must:
1. Identify the exact equipment, model, serial number, revision, voltage, refrigerant, and application.
2. Verify every specification, wiring connection, clearance, rating, torque, charge, piping procedure, diagnostic step, and safety instruction against the current manufacturer documentation and applicable codes.
3. Inspect actual field conditions, instruments, equipment condition, and work area.
4. Use appropriate professional-grade tools, personal protective equipment, lockout/tagout, recovery procedures, and safety controls.
5. Obtain any required second opinion, permit, inspection, or manufacturer or code-official direction.
The Service does not establish a technician’s standard of care and does not confirm that a repair, installation, diagnostic determination, wiring change, or configuration is safe, legal, complete, or covered by a warranty.
3.1 Feedback and continuous improvement
Technical accuracy is important to us, and we welcome field corrections and documentation updates. You may submit a correction through Settings → Send Feedback or Report an Issue, or through the feedback option on the Home screen. Select Content Request or Bug Report and, where possible, include the exact equipment model number, affected app screen, proposed correction, and relevant factory documentation reference. Do not include unnecessary customer information, credentials, or confidential material.
4. ASSUMPTION OF RISK AND RESPONSIBILITY
You use the Service at your own risk. You assume responsibility for evaluating information and for all decisions, diagnoses, installations, repairs, maintenance, refrigerant handling, electrical work, wiring changes, measurements, testing, and other acts or omissions made after or while using the Service. You are solely responsible for protecting people, property, equipment, data, and the environment, and for any customer communications, records, permits, warranties, and results.
You acknowledge that HVAC equipment and work may involve high-voltage electricity, high-pressure refrigerants, extreme temperatures, moving parts, combustion, toxic substances, confined spaces, heights, water, sharp metal, and other hazards. You will not use the Service while distracted or in a way that substitutes a screen for observing the work area.
5. NO PROFESSIONAL, EMERGENCY, OR SAFETY ADVICE
The Service is not an engineering, electrical, legal, medical, environmental, code-compliance, or emergency service. It does not create a professional-client, employment, agency, fiduciary, or other advisory relationship. Do not use the Service as the sole basis for an emergency response or a decision that could reasonably cause injury, death, property damage, or equipment damage.
6. AVAILABILITY AND CHANGES TO THE SERVICE
We may add, change, suspend, restrict, or discontinue any feature, content, device support, or part of the Service, temporarily or permanently, with or without notice. We do not promise that the Service or any particular content will always be available, accurate, compatible, secure, uninterrupted, or error-free. Offline or cached material can become stale. You are responsible for maintaining independent copies of business records and for using current manufacturer materials.
7. LIMITED LICENSE
Subject to this Agreement and payment of applicable charges, HVAC Pocket Pro grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use one authorized copy of the Service on devices you own or control, solely for your own lawful professional reference and productivity purposes. This is a license, not a sale. You may not rent, lease, lend, sell, sublicense, distribute, reproduce, or commercially exploit the Service except as this Agreement expressly permits.
The license ends automatically when this Agreement or your authorized access ends. Apple App Store or Google Play Store terms may also apply to an app downloaded through that store. Those stores are not parties to this Agreement and are not responsible for the Service or its support, except as their own terms require.
8. ACCOUNTS AND SECURITY
Some features require a Firebase Authentication account or other credentials. You must provide information that is accurate to the extent requested, keep credentials and devices secure, and promptly notify us of suspected unauthorized access. You may not share an account, impersonate another person, use another person’s credentials, or attempt to bypass authentication or access controls. You are responsible for activity under your account, except to the extent caused by our failure to use reasonable security measures or otherwise required by law.
9. SUBSCRIPTIONS, RENEWALS, AND PROMOTIONAL ACCESS
Certain features require a paid subscription or promotional access. Prices, duration, trial or promotion terms, eligibility, and available plans are shown at purchase or redemption. Subscriptions purchased in the Apple App Store or Google Play are billed, renewed, and managed by the applicable store under its terms. Unless the store’s terms provide otherwise, a subscription renews for the same period at the then-current price unless you cancel before the renewal deadline shown by the store. Deleting the application does not necessarily cancel a subscription.
You must use the applicable Apple, Google, or in-app account to manage cancellation, payment method, refunds, and billing issues. We do not receive or store your payment-card number for those purchases. Promotional codes are limited, may expire, may be restricted to eligible users, may not be sold or transferred, and may be revoked for misuse, error, fraud, or violation of this Agreement. A promotional code does not create a promise that the Service will remain available for its full stated duration if access is lawfully suspended or discontinued.
10. INTELLECTUAL PROPERTY AND FEEDBACK
The Service, including its software, user interface, branding, designs, compilations, original text, and non-user-generated content, is owned by or licensed to HVAC Pocket Pro and is protected by intellectual-property and other laws. Except for the limited license above, we reserve all rights. “HVAC Pocket Pro,” “Ductless Master,” logos, and related names are our marks or those of their respective owners. Manufacturer names, marks, manuals, and specifications belong to their owners; their appearance in the Service does not imply endorsement or affiliation.
You retain rights you have in content you submit. You grant HVAC Pocket Pro a worldwide, non-exclusive, royalty-free license to host, reproduce, process, transmit, display, and use that content as reasonably necessary to operate, secure, support, improve, and provide the Service, including sending feedback to our service providers. You represent that you have the rights and permissions needed to submit it. If you send a correction or suggestion, you grant us permission to use it without compensation or confidentiality obligation. Do not submit confidential customer information, trade secrets, credentials, or personal information that is not necessary.
11. PROHIBITED USES
You may not, and may not help another person to:
• Use the Service if you are under 18 or not appropriately trained and authorized.
• Use it for an unsafe, unlawful, fraudulent, abusive, infringing, harassing, or deceptive purpose.
• Rely on it instead of current manufacturer instructions, applicable law, a qualified professional, or an on-site safety assessment.
• Reverse engineer, decompile, disassemble, decode, modify, translate, create derivative works of, or attempt to discover source code or models, except where non-waivable law permits.
• Copy, scrape, bulk-download, frame, mirror, resell, publish, distribute, or make the Service or its content available to third parties.
• Remove notices, defeat rate limits, bypass a subscription or access control, probe or test vulnerabilities without written authorization, or interfere with operation.
• Introduce malware, automate requests in a way that burdens the Service, or use another person’s identity or account.
• Submit content that violates privacy, confidentiality, intellectual-property, or other rights.
• Use Service content to train AI models or to make automated decisions about a person without appropriate authorization and safeguards.
12. THIRD-PARTY SERVICES AND MATERIALS
The Service may depend on or link to third-party services, including Firebase, RevenueCat, Apple App Store, Google Play, hosting and storage providers, email providers, and search providers. Third-party services are governed by their own terms and privacy policies. We do not control and are not responsible for their availability, security, content, actions, or terms. Manufacturer content is supplied for reference and may change; always verify it with the current source.
13. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. HVAC POCKET PRO DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE AVAILABLE OR UNINTERRUPTED, BE SECURE OR ERROR-FREE, OR PRODUCE A PARTICULAR RESULT. WE DO NOT WARRANT THAT INFORMATION IS CURRENT, COMPLETE, OR SUITABLE FOR ANY EQUIPMENT, JURISDICTION, OR FIELD CONDITION.
Some jurisdictions do not allow all disclaimers, so some of these limitations may not apply to you. Nothing in this Agreement excludes a warranty or right that cannot lawfully be excluded.
14. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, HVAC POCKET PRO LLC AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, DEVELOPERS, CONTRACTORS, LICENSORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL LOSS OR DAMAGE, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, USE, EQUIPMENT, OR WARRANTY, ARISING FROM OR RELATED TO THE SERVICE OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY. THIS INCLUDES PERSONAL INJURY, DEATH, PROPERTY DAMAGE, EQUIPMENT DAMAGE, WARRANTY VOIDANCE, LABOR DISPUTES, OR BUSINESS INTERRUPTION ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, TO THE EXTENT THE LAW PERMITS.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THIS AGREEMENT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. THIS LIMIT DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING LIABILITY FOR OUR FRAUD, WILLFUL MISCONDUCT, OR OTHER LIABILITY THAT APPLICABLE LAW MAKES NON-LIMITABLE.
15. INDEMNITY
To the extent permitted by law, you agree to defend, indemnify, and hold harmless HVAC Pocket Pro and the persons and entities listed in Section 14 from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your unlawful or prohibited use of the Service, your violation of this Agreement, your content, or your professional acts or omissions. We may assume exclusive defense of a matter subject to indemnification, and you will reasonably cooperate. This section does not require indemnification to the extent caused by our own conduct where applicable law prohibits it.
16. TERMINATION AND SUSPENSION
You may stop using the Service at any time. We may suspend or terminate access, an account, a subscription feature, or this Agreement if we reasonably believe you violated this Agreement, created a safety or security risk, failed to pay, engaged in fraud or abuse, or where required to protect the Service or comply with law. We may also discontinue the Service as described above. Termination does not erase obligations or rights that by their nature should continue, including Sections 1.1, 4, 7, 10–15, 17, and 18. Any refund is governed by the applicable store’s rules and applicable law.
17. CHANGES TO THIS AGREEMENT
We may revise this Agreement. We will post the revised version and update the effective and last-updated dates and version. For a material change, we may provide an in-app notice, email, or other reasonable notice. Where renewed acceptance is required, access to affected features may require acceptance of the new version. Your continued use after a change becomes effective constitutes acceptance to the extent permitted by law. If you do not agree, stop using the Service and contact us about available account or subscription options.
18. ILLINOIS LAW AND DISPUTES
This Agreement is governed by the laws of the State of Illinois, United States, without regard to conflict-of-law rules, except to the extent applicable law requires otherwise. Before filing a formal claim, you and HVAC Pocket Pro agree to try in good faith to resolve the dispute by contacting info@hvacpocketpro.com with a description of the issue and requested resolution; allow at least 30 days for that effort.
If the dispute is not resolved, any court proceeding will be brought in the state or federal courts located in Illinois, and each party consents to those courts’ personal jurisdiction and venue, unless applicable law gives you a non-waivable right to proceed elsewhere. Nothing in this section prevents either party from seeking temporary or injunctive relief in an appropriate court, pursuing a small-claims matter where eligible, or exercising a right that cannot lawfully be waived. We have not represented that this dispute provision is appropriate for every person or circumstance. Consider obtaining independent legal advice about your rights and any dispute before taking action.
19. GENERAL TERMS
If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A waiver must be in writing and applies only to the instance for which it is given. You may not assign this Agreement or your account without our written consent; we may assign it in connection with a merger, reorganization, financing, sale of assets, or operation of law. This Agreement is the entire agreement about the Service and supersedes prior agreements about the same subject, except for express purchase terms. Headings are for convenience. Nothing creates a partnership, agency, employment, fiduciary, or joint venture relationship. Notices may be delivered in the Service, by email, or at the contact address below. Provisions that should survive termination will survive.
